Obtains injunction against the Gamestar
The Zuxxez Entertainment AG has obtained an injunction against the Gamestar, because they allegedly tested and bad based on incorrect facts so wrongly evaluated an unauthorized version of the game “Knightshift”.
By obtain a preliminary injunction from the Landgericht Hamburg, the test in this version may no longer be distributed. ‘Knightshift’ is hot expected by many, the Gamestar gave the title based on a prerelease version, which was not released at all for a test according to blockbuster, but only 69 per cent, which could mean significant sales volume for the developer. According to blockbuster, the prerelease version tested by the Gamestar has several gaffes and constraints that are no longer exist in the retail version. Alexander Constandache of Blockbuster is expressed as follows: “this CD was released as a test CD.” “And so it is not surprising that the review only so from the failure is full.”The game to have, for example, by no means only 18 missions, such as that reported Gamestar in their test, but ready hold well over 20 missions in the retail version for the player. The multiplayer mode was not only in the RPG part possible, as the Gamestar reported, as blockbuster.
Dirk Hassinger, who is responsible for sales, is also strong words: “this unbelievable sloppiness weigh all the more worse, than that the test result of the demo CD just had 69 percent.” The damage Gamestar causes with false reporting, is incalculable. Just shortly before the appearance of the products the customer sees exactly there and often aligns its purchasing decisions on such reviews. “We fear that this report will have a direct effect on the sales figures.”
From a correction which looks at the moment however Gamestar according to blockbuster and so blockbuster hoped for with the obtained interim injunction the “in to limit damage at least something.” “Gamestar must expect that we replaced require the damage caused us by this test unclean and sloppily researched.”
In game magazines, it happens while more frequently that pre-release versions to be tested, to inform the purchaser aware in a timely manner about a product. However, blockbuster, seems this with the sending of its version to the Gamestar does not intend to have. Extent to which only a poor communication between Zuxxez and the Gamestar took place, or whether blockbuster had expressly pointed out that the pre-release version not as a basis for testing may be used, is unfortunately not known. So the Gamestar could assume may not, that this version could not be used as test basis. The exact circumstances know only blockbuster and the Gamestar itself. The Gamestar has moved so far but still not in a position on the allegations.
